Introduction
These Terms govern your use of the GravityX website and services. By using our site, you agree to these Terms.
Bookings and Payments
- All bookings are subject to availability. Payment is required at the time of booking.
- Cancellations must be made at least 24 hours before your booking to qualify for a refund.
Membership Terms
- Memberships are non-transferable. Benefits apply only to the registered user.
- Membership fees are non-refundable, except as required by law.
Liability and Safety
- GravityX is not liable for injuries sustained due to non-compliance with safety guidelines.
- Users participate at their own risk.
Risk Acknowledgement and Waiver
By participating in our indoor surfing, skiing, and flowriding activities, you acknowledge and accept the inherent risks associated with these activities, including falls, collisions, and muscle strain.
Liability and Indemnity Clauses
To the extent permitted by New Zealand law, GravityX and its affiliates shall not be liable for any injuries or damages incurred while participating in activities. Participants agree to indemnify and hold GravityX harmless from any claims or expenses arising from their participation.
Health and Fitness Requirements
It is the participant’s responsibility to ensure they are in good health before engaging in activities. Please inform our staff of any medical conditions that may impact your ability to participate safely.
Refund Policy for Top-Up Members
Refund Eligibility
Top-up members may qualify for a full or partial refund if they meet one of the following conditions:
- Personal injury: The member is injured and unable to participate in GravityX activities for a period exceeding two months.
- Severe illness: The member is suffering from a serious medical condition and is unable to participate in GravityX activities, with proof of the condition.
- Pregnancy: The member is pregnant and unable to participate in GravityX activities for a significant period.
Refund Request Process
All refund requests must be submitted in writing, along with supporting documentation (e.g., a doctor’s note). Requests should be sent via email to admin@gravityx.co.nz, and we will process the request within 14 business days of receipt.
Refund Calculation
Refunds will be calculated based on the regular value of the remaining top-up balance, not on any discounts or bonus credits received during the top-up. We will deduct the value of the portion used and refund the remaining unused balance. Refunds will be based on the actual amount paid during the top-up, excluding any bonus credits given as part of the promotion.
Refund Method
Any refunds will be returned to the original payment method or another method determined by GravityX at our discretion. The membership will be cancelled once the refund is processed.
Non-Refundable Situations
- If bonus credits have been used but the refund conditions are not met.
- If the membership has been cancelled and does not qualify for a refund.
- If the member chooses not to use the remaining balance without meeting the refund eligibility criteria.
Changes to Terms
We reserve the right to update these Terms at any time. Continued use of the site constitutes acceptance of any changes.
